Family and Medical Leave Act

You work hard every day to ensure your company’s success. You also care about your employees and do everything you can to take care of them. In exchange, you expect them to work hard and take care of their responsibilities. The Family and Medical Leave Act (FMLA) requires employers to provide up to 12 weeks of unpaid leave each year. Furthermore, their job must be protected while they are out. In other words, when they come back, they may resume their position with the company and maintain their group health benefits.

The Purpose of the FMLA

The FMLA allows for people to take care of difficult situations at home without worrying about losing their job or healthcare coverage. Unfortunately, it is also an area where unethical employees can push the boundaries, or even commit fraud outright.

The FMLA applies only when there is a qualifying event such as the birth of a child or when someone adds to their family through adoption or foster care. It also may be used to take care of an immediate family member with a serious health condition, or even when the employee is the one with a serious health condition. Unfortunately, it’s difficult to determine if your employees are taking advantage of the benefits of the law—or just taking advantage of you.

Our Surveillance Services Protect Your Best Interests

Employees seldom fake the birth of a newborn. Some lies are just a bridge too far, but it is not that hard to claim that a relative, or even the employee themself, is sick. Often, these instances start out as legitimate events that meet the qualifications of the law, but over time, the need diminishes, and the employee doesn’t resume their duties in a timely manner.

Obviously, you want your employees to take care of themselves and their loved ones, but you need them back at work when they are able to return. After all, if you didn’t need them, you wouldn’t have hired them in the first place.

This can be a sensitive issue. Accusing an employee of taking advantage of their situation when they really are suffering is a good way to lose a good employee or cause a legal issue for your business. On the other hand, you really do need to know what is actually happening. That is where we come in. Since 2009, Exclusive Investigations has provided surveillance services to protect employers from employees who may be abusing the FMLA or otherwise taking advantage of the company. We do more than get answers—we get evidence—and best of all, we do it discreetly. If you were wrong, you get peace of mind and no hard feelings.
